Agreement to our legal terms

Elite Construction Group ("Company," "we," "us," or "our") operates https://elite-constructiongroup.com and related products and services that link to these Terms (collectively, the "Services"). We may update these Terms from time to time. The date above identifies the latest revision. Your continued use of the Services after revised Terms are posted means you accept the changes.

The Services are intended for users who are at least 18 years old.

1. Our services

Elite Construction Group provides information about residential and commercial concrete services, including driveways, patios, sidewalks, foundations, repairs, and property management assessments. Website information and inquiries do not guarantee project availability or constitute a binding estimate. Scope of work, pricing, scheduling, warranties, and payment terms are governed by a separate written agreement.

If you access our website from another location, you are responsible for compliance with local laws. General forms and SMS are not intended for sensitive financial information or urgent safety concerns.

2. Intellectual property rights

Unless otherwise stated, we own or license the software, website design, text, photographs, graphics, logos, trademarks, and other content made available through the Services. These materials are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Services and download or print portions of the content solely for your personal or internal business use. No content may be copied, reproduced, sold, licensed, published, or exploited for commercial purposes without our prior written permission.

4. Estimates, contracts and payments

Submitting an inquiry or requesting an estimate does not create a construction contract. Project scope, pricing, scheduling, deposits, payment methods, change orders, cancellation terms, and applicable warranties must be set out in a separate written agreement. That agreement controls over general website information.

Where online accounts or payments are offered, you are responsible for accurate information and keeping any credentials confidential. You authorize only the charges you approve. Payment providers may process payments under their own terms.

5. Prohibited activities

You may use the Services only for their intended purpose. You may not:

• Systematically retrieve, scrape, harvest, or compile data from the Services without written permission.
• Circumvent security features, interfere with the Services, introduce malicious code, or overload our systems.
• Use bots, scripts, spiders, or other automated tools except standard search-engine indexing.
• Impersonate another person, submit false information, harass others, or use information obtained from the Services to harm anyone.
• Copy, reverse engineer, frame, mirror, or use the Services to build a competing product or service.

Information you send through contact forms, estimate requests, or other interactive features must be lawful and must not infringe another person’s rights. You remain responsible for what you submit.

Please do not send sensitive financial documents, passwords, or payment card information through general website forms. We may use non-confidential feedback to improve our website and services; personal information remains subject to our Privacy Policy.

7. Services management

We may monitor the Services, investigate suspected violations, restrict access, remove content, or take appropriate legal action to protect the Company, our customers, or others. We are not obligated to monitor every activity or submission.

11. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12. Dispute resolution

Before filing a claim, you agree to contact us at jennifer@elitegroupkc.com and attempt in good faith to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Services must be brought in the state or federal courts serving Cass County, Missouri, and each party consents to those courts' jurisdiction and venue.

13. Corrections

The Services may contain typographical errors, inaccuracies, or omissions, including descriptions, availability, and pricing. We may correct or update that information at any time without prior notice. A separate written agreement, where applicable, controls over general website content.

14. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, ACCURATE, COMPLETE, OR UNINTERRUPTED.

Website content is general information, not site-specific engineering, architectural, legal, or safety advice. Website use does not establish a contractor-client relationship. 15. Limitations of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID THROUGH THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its owners, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable legal fees arising from your misuse of the Services, your breach of these Terms, or your violation of another person's rights.

We may maintain information you submit to operate the Services. Although we take reasonable steps to protect and back up information, you are responsible for retaining copies of information important to you. Our handling of personal information is described in the Privacy Policy.

18. Electronic communications and signatures

Visiting the website, sending email or text messages, creating an account, completing forms, and making online payments are electronic communications. You consent to receive records electronically and agree that electronic signatures, notices, disclosures, and records satisfy legal writing requirements, subject to applicable law.

21. Miscellaneous

If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights without our consent; we may assign ours as permitted by law. These Terms do not create a partnership, employment, or agency relationship.
